Delays, Cancellations, etc.

Delays, cancellations and overbooking may occur on air flights, cruises, and land reservations by the participating carriers and suppliers. ABW Travel Agency cannot and will not assume responsibility for their or anyone’s acts. ABW Travel Agency shall not be held liable for potential risks and any and all hazards associated with travel where injury of any type, delays or methods of doing business or substandard or negative conditions or any other adverse conditions have or may occur.

ABW Travel Agency shall not be responsible nor assume any liability for any of the following:

1. Any cancellation of services by the supplier of any liability in arranging transportation, hotel and other accommodations ABW Travel Agency nor its agents is not responsible for any personal injury, illness or property damage or other loss or expense of any nature whatsoever arising directly or indirectly out of any actions of any person or supplier of services, programs or accommodations. You are participating in any travel arrangements at your own risk and ABW Travel Agency assumes no responsibility for disappointments at all or for any death, injury, illness, sickness, disease, natural disaster, injury, loss, delay, act of God, accident, expenses or defect that may result from your travel. We strongly recommend that you use a credit card for your purchase, so that you can exercise your rights under the Fair Credit Billing Act if you do not receive services you purchased.

2. Any change or modifications by the supplier of itineraries, air carrier, routing, scheduling, departure date, level of accommodations, etc.

3. Fluctuations in fares, rates, surcharges and/or price differentials.

4. ABW Travel Agency sole responsibility is to book your travel and will not be responsible for anything other than booking your travel. All travel is solely the responsibility of the passenger and not of ABW Travel Agency.

If you wish to leave from any city other than the gateway cities provided in the cruise/tour package, etc., or elect to change the air routing provided by the cruise/tour package, ABW Travel Agency will at your direction, reschedule your transportation at the adjusted current tariff and deviation charges. It is the responsibility of the passenger to re-confirm his/her flights with the airlines. Flights may be missed due to schedule changes or other acts and air schedule changes may cause cancellations, ABW Travel Agency assumes no liability for said changes or cancellations.

All cruise lines, train lines, bus lines, airlines, and tour companies have their own cancellation policies.., It is the responsibility of the purchaser to acquaint him/herself with said policy, Should a cancellation become necessary, please inform ABW Travel Agency immediately in writing (at cancellations@abwtravelagency.com) and request a written confirmation of your cancellation..

Cancellation & Refunds:

IN ADDITION TO ANY AND ALL CANCELLATION PENALTIES IMPOSED BY THE SUPPLIER, CRUISE LINES, TRAIN LINES, BUS LINES, AIRLINES, AND TOUR COMPANIES , ETC., ABW TRAVEL AGENCY MAY ASSESS THE FOLLOWING CANCELLATION PENALTIES:

1. $50.00 PER PERSON/ADULT ADMINISTRATIVE FEE FOR ANY CRUISE/TOUR CANCELLED BY THE CLIENT. (76 OR MORE DAYS PRIOR TO DEPARTURE. PROCESSED THROUGH PAYPAL OR CHECK.)

2. FOR CANCELLATIONS MADE WITHIN 75 DAYS OF DEPARTURE, A CANCELLATION FEE OF 15% OF THE TOTAL PACKAGE MAY BE ASSESSED.   (PROCESSED THROUGH PAYPAL OR CHECK.)

3. REGARDING AIRLINE TICKETS: IF ABW TRAVEL AGENCY BOOKED YOUR TICKETS, THEY ARE 100% NON-REFUNDABLE AND SUBJECT TO INDIVIDUAL AIRLINE PENALTIES/FEES.

LIMITATION OF USE

The content and information on this Site, such as prices, and the infrastructure used to provide such content and information, is proprietary to ABW Travel Agency or its suppliers and providers. You agree not to use this Site or its contents or information for any commercial or non-personal purpose.  In addition, whether or not you have a commercial purpose, you agree not to:

1.  access, monitor or copy any content from this Site using a robot, spider, scraper or other automated means or any manual process for any purpose;

2.  violate the restrictions in robot exclusion headers on this Site or bypass or circumvent other measures employed to prevent or limit access to this Site;

3.  take any action that, in ABW Travel Agency sole discretion, imposes an unreasonable or disproportionately large burden on the Site; or

4.  deep-link to any portion of this Site (including, without limitation, the purchase path for any travel services).

LIMITATION OF LIABILITY, NO REPRESENTATIONS

ABW TRAVEL AGENCY HAS NO LIABILITY FOR, AND WILL MAKE NO REFUND IN THE EVENT OF, ANY DELAY, CANCELLATION, OVERBOOKING, STRIKE, FORCE MAJEURE OR OTHER CAUSES BEYOND ITS DIRECT CONTROL.  ABW TRAVEL AGENCY TAKES NO RESPONSIBILITY FOR ANY ADDITIONAL EXPENSE, OMISSIONS, DELAYS, RE-ROUTING OR ACTS OF ANY GOVERNMENT OR AUTHORITY. BY OFFERING FOR SALE TRAVEL TO PARTICULAR INTERNATIONAL DESTINATIONS, ABW TRAVEL AGENCY DOES NOT REPRESENT OR WARRANT THAT SUCH TRAVEL IS WITHOUT RISK.

• International Travel: You should read government-issued travel prohibitions, warnings, announcements and advisories before booking international travel.  This information can be obtained from State.gov, TSA.gov, Transportation.gov, FAA.gov, CDC.gov, Treasury.gov and Customs and Border Protection

PROMOTIONS AND PRICING

• Price and availability of all travel and other services offered on this Site is subject to change without notice.  Tax on hotel and car transactions is a recovery of all applicable transaction taxes (e.g. sales and use, occupancy, room tax, excise tax, value added tax, etc.) that ABW Travel Agency pays to suppliers in connection with your travel arrangements.  Taxes vary by location and type of service provided. ABW Travel Agency is not a co-vendor, and is not the entity that collects and remits taxes to the tax authorities.

• The information on this website may contain typographical errors or inaccuracies and may not be complete or current. We therefore reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice. Please note that such errors, inaccuracies or omissions may relate to product/service description, pricing and availability. ​

• These Terms constitute a binding agreement between you and ABW Travel Agency, and are accepted by you upon your use of the Site or your account. These Terms constitute the entire agreement between you and ABW Travel Agency regarding the use of the Site and your account.

Credit Card authorization & Identification requirements

Providing ABW Travel Agency with credit card information for payment assumes that the passengers and clients are authorizing their credit card information to be used for payment of their travel plans, both deposits and final payments for travel arrangements made by ABW Travel Agency. It is the travelers responsibility to inform ABW Travel Agency of any changes to their credit card information (ie. credit card number, expiration date and security number).

All passengers 16 years of age and over must have government-issued photo identification for domestic travel. All passengers including children must posses a Valid Passport (valid for at least 6 months past the return date), appropriate visas  and documents (when required) for international travel. The name on your ticket/travel documents must match the name on your I.D. or Passport exactly. It is the travelers responsibility to provide ABW Travel Agency with the correct valid name.

ABW Travel Agency is not responsible for any penalties accessed by the supplier for an invalid name provided or incorrect spelling of the traveler’s name.

ABW Travel Agency has no special knowledge regarding the financial condition of the suppliers, unsafe conditions, health hazards, weather hazards, or climate extremes at locations to which you may travel. You, the traveler, assumes full and complete responsibility for checking and verifying any and all passport, visa, vaccination, or other entry requirements of your destination(s), and all conditions regarding health, safety, security, political stability, and labor or civil unrest at such destination(s). For information concerning such requirements and possible dangers at destinations, we recommend contacting the Travel Warnings Section of the U.S. State Department at www.travel.state.gov. For medical information, we recommend contacting the Centers for Disease Control at www.cdc.gov/travel. You hereby release ABW Travel Agency from all claims arising out of any problem covered in this the foregoing paragraphs. You agree that the courts in Grandview, Missouri, will be the exclusive jurisdiction for all claims brought by you or ABW Travel Agency, and you hereby submit to the personal jurisdiction of those courts.
